We believe it is important to let you know what information is collected by the website “Mentality” (the “website”), for what reasons we collect the information, and how we use it. This privacy policy forms a part of our terms of use, and is incorporated thereto by reference. Capitalised words not otherwise defined herein shall have the meaning given to such terms in the terms of use. The website does collect personal data, which enables us to provide you with the uttermost personalised shopping experience. This also allows us to contact you regarding your purchases and/or for marketing purposes. It is crucial to highlight that we do not sell your personal data, or any other data collected to anyone.


HOW DO WE COLLECT INFORMATION?


We collect information about you when you engage in the following ways:

When you place an order or contact us.

When you subscribe to our newsletters and other marketing platforms.

When you register on our site you will be asked to submit some personal information, such as your name and contact information.

When you ask for information, provide a review or feedback, or comment on articles published on the website.

When you register your personal information with the website, you consent to the use of your personal data according to this privacy policy and those consents which you approve during the registration process and/or by your continued use of the website.


NON-PERSONAL DATE WE COLLECT


Subject to your consent to the terms of this privacy policy, we will collect the internet browser you use, your number of visits to the website, your average time spent on website, pages viewed, etc. We use this information to improve usability and to improve content and functionality.


WHAT TYPES OF PERSONAL DATA DO WE COLLECT?


The personal data we collect includes contact information such as date of birth, product preferences and payment information, email address and home address, and in addition, we may collect certain personal data from external sources (referred to as "personal data"). We do not store any payment information past the point of purchase. Your email address may be used for marketing and offers we think are most relevant for you, unless you chose otherwise. We do only collect the information stated which is classified as ‘identifiers’ by the CCPA.

This privacy policy does not apply to the practices of companies that we do not own or control, or third party services you interact with. We are not responsible for the privacy practices or the content of these third party services. Accordingly, we encourage you to review the conditions of each Third Party Service that you choose to use or interact with.


SECURITY


The security of your Personal Data is important to us. All data transferred on our site is encrypted with TLS and complies with strict security standards. Payment information is transferred in a secure manner to our payment providers. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. CHILDREN PRIVACY


Our services are not intended for children under the minimum age for providing consent in the jurisdiction they reside in (such as 16 in certain countries in the EU; “Legal Age”), and we do not knowingly obtain personal information from children under the Legal Age without parental consent. If we learn that we have collected such information, we will delete it as quickly as possible. COOKIES


The website places small packets of data, known as cookies, onto users’ computers and mobile devices. This is standard practice that all online businesses apply. Cookies are an integral part of assisting the website in providing a high quality online shopping experience to all users

Users are able to disable cookies from their browser, if they wish too. However, take into account that with disabling cookies we may be unable to provide you with some of the services offered by the website.

We also share information about your use of our website with our social media, advertising and analytics partners, who may combine it with other information you provided to them or that they have collected from your use of their services.

Your use of the website shall mean that you consent to our cookies policy and use.

By subscribing to Mentality text notifications, you agree to receive automated marketing text messages from us about our products and services at the phone number you provided when you subscribed, and that the messages may be sent via automatic telephone dialing system or other technology. Message frequency is recurring. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP, END, CANCEL, UNSUBSCRIBE or QUIT to opt-out and HELP for customer support. You may receive an additional text message confirming your decision to opt-out.  You understand and agree that attempting to opt-out by any means other than texting the opt-out commands above is not a reasonable means of opting out.

 


THE MENTALITY APP


This section covers the MENTALITY app for iPhone. Everything else in this policy applies to the app too; this part adds what is specific to it.

On your iPhone. Private notes and reminder settings stay on your device, and so do your streak history and saved drops if you don't have an account. We can't see them. Deleting the app, or tapping You → Reset app data, removes them.

Your MENTALITY account. The streak, stories, Library and Crew leaderboards come with a free account. You sign up with Apple or Google: we receive an account identifier and, if you share it, your email address (Sign in with Apple can hide it behind a private relay address). You then pick a handle. With an account we store your handle (public on Crew leaderboards), your challenge totals such as daily steps and daily check-ins (public as totals and ranks), the drops you save (so we can show how many people saved a drop, never who), and reports you send about other members. For Sign in with Apple we also keep a token from Apple so we can revoke the sign-in when you delete your account. Without an account we keep no profile or handle for you.

Steps and camera. If you join the steps challenge, the app reads today's step count from Motion & Fitness and sends the daily total. Push-up counting, when available, uses the camera on your iPhone with Apple's Vision framework: only the number of reps is sent, and video is never recorded or uploaded. Photos access is add-only, used when you save a share image.

Notifications. Daily drop reminders are scheduled on your iPhone. If you turn on "Drops & offers", the app registers your iPhone with Klaviyo, our marketing platform, which receives your device's push token and, if you're signed in to your store account, your email address, and records when you open one of these notifications. Our own server also keeps the push token so the MENTALITY team can send drop announcements. Turn "Drops & offers" off in the You tab at any time. See Klaviyo's privacy notice.

App opens. To count how many people use the app and when, the app tells our server when it's opened (after 30 minutes or more away): a random ID created when the app is installed (not your device's identifier or an advertising ID), the app version and the time, and your account if you have one. We use it only to count usage, keep it for 13 months, and delete it with your account.

Shopping and your store account. Checkout in the app runs on Shopify, the same as on this website. If you sign in to your store account in the app, it reads your name, email, orders and shipment tracking from Shopify and keeps a copy on your iPhone so it loads quickly; your sign-in keys stay in the iPhone Keychain. Signing out removes them.

Athlete Program. When you apply, your answers (such as your name, email and social handles) go to our team through Klaviyo, and the video link you submit goes to our review form. To show your Athlete badge or ambassador code, the app sends your store sign-in key to our server, which checks your account with Shopify and with BixGrow, our affiliate platform (see BixGrow's privacy policy). For the badge we keep only a one-way identifier of your store account and the date.

No tracking in the app. The app has no advertising SDKs, and we don't share data collected in the app with advertising networks or data brokers, or use it to track you across other companies' apps and websites.

Deleting your data. You → Delete account removes your MENTALITY account, handle, challenge progress, ranks, saves, reports and app opens from our server and revokes Sign in with Apple. You → Account → Delete store account (or "Delete account and store account") asks us to erase your store account: our server confirms the request with Shopify, and we erase your personal details within 30 days. Records of past sales stay without your name or contact details. You can also contact us using the form above.

Where it's stored. App account data is hosted by our infrastructure provider, Render, in the United States, and kept until you delete your account.


UPDATES TO OUR PRIVACY POLICY
